Soon after purchasing their property, the homeowners received a notice from the town advising that multi-year sewer upgrade work had been completed and now the town would be voting on a bylaw to pass a portion of the costs on to area residents. Their share was expected to be several thousand dollars.

They had not been informed of the sewer work at the time of purchase, even though the vendor would have been notified. Because the local improvement charge had accrued prior to the policy date, the claim was covered. Once the town approved the charge and formally invoiced the homeowners TitlePLUS reimbursed them the cost.
