Homeowners were surprised to receive a letter from a company enclosing a survey that showed a significant portion of what they believed to be their property was, in fact, owned by the company. Worse, the parcel of land they didn’t own included their driveway. The company offered the insureds an opportunity to purchase the parcel before it was listed on the open market.

A review of the survey available at the time of the original purchase confirmed that the driveway was not on the same parcel as the land being purchased. Because this was overlooked by the lawyer who acted on the purchase, the claim was covered by the TitlePLUS policy’s legal service coverage.

Without the parcel, the property would have required an expensive new driveway be built, along with a possible diminution in property value. Therefore, TitlePLUS agreed to negotiate the purchase of the parcel and to have it transferred to the ownership of our insureds.
